Trucking Accidents

Thomas Kennedy has decades of experience and the specialized skills needed to defend trucking companies and insurers against trucking accident claims in Georgia. Premises Liability

Thomas Kennedy has literally handled hundreds of claims brought by persons injured while on the premises of another.  The lawyers at Thomas Kennedy have considerable experience in defending wrongful death actions resulting from third-party criminal activity on all types of property, including apartment complexes and transportation facilities.  Our lawyers have also defended numerous cases in which parties have been injured by fire while on the premises of another, as well as cases involving lead poisoning.  We have also successfully defended hundreds of slip-and-fall cases, many resulting in summary judgment.

Thomas Kennedy is currently involved in the defense of eight lawsuits, including four wrongful death matters, arising from the tragic events of March 11, 2005 at the Fulton County, Georgia Courthouse, where a sitting judge, a court reporter, a sheriff's deputy, and an ATF agent were killed.

Environmental Litigation

In 2003, Thomas Kennedy was called upon to serve as co-counsel for Vulcan Materials Company in a lawsuit brought by more than 50 homeowners who alleged that blasting operations at Vulcan's Atlanta quarry had caused major structural damage to their homes.  The case was successfully concluded in 2006.

Product Liability

Thomas Kennedy routinely defends product liability cases on behalf of one of the country's largest elevator/escalator companies.  Those cases arise from persons being injured while riding escalators or while passengers on elevators.  In addition, Thomas Kennedy has been involved in the defense of product liability cases on behalf of America's two largest automobile manufacturers.  We have also been involved in medical products litigation involving knee implants.

Currently, Thomas Kennedy is representing several defendants in a medical malpractice/product liability case involving one of the country's most well-known pharmaceuticals.  We are also currently defending the world’s largest imaging and photographic company in a lawsuit brought by a hospital patient who alleges to have been injured as a proximate result of a defect in a medical imaging product manufactured by the company.

Medical Malpractice

The attorneys at Thomas Kennedy have considerable experience in defending medical malpractice actions and are currently involved in the defense of more than a dozen such cases, including several alleging wrongful death.  We have been called upon to represent numerous doctors as well as Atlanta's two medical schools and Atlanta’s largest hospital in the defense of such cases.

Employment Litigation

Thomas Kennedy has been involved in the defense of various types of employment matters, including lawsuits alleging race, age, gender, and national origin discrimination under Title VII of the Civil Rights Act.  Thomas Kennedy has also defended cases involving the Family Medical Leave Act and the Equal Pay Act.  Thomas Kennedy was called upon by The Coca-Cola Company to serve as co-counsel help represent it in a major class action lawsuit alleging race discrimination, as well as in several opt-out cases arising from that class action.

Commercial Litigation

Thomas Kennedy has been called upon to represent numerous corporations and individuals in various types of commercial litigation, including significant breach of contract actions.  In 2004, Thomas Kennedy successfully represented The Coca-Cola Company and recovered more than $44 million for breach of contract against the defendant.  Also in 2004, Thomas Kennedy was successful in obtaining summary judgment on behalf of one of the world’s largest paper products company in a contract dispute, wherein the plaintiff sought a multimillion dollar recovery.  The case was subsequently affirmed by the Court of Appeals of Georgia.
